SB 119 aa concerning used motor vehicle warranties

Status: Awaiting Action (General Law Committee)

Provides that (1) a dealer selling a used motor vehicle that is less than 10 years of age shall not exclude, modify, disclaim or limit an implied warranty on the vehicle, (2) each contract entered into by a dealer for the sale of any such used motor vehicle to a consumer shall include an express warranty that the vehicle is mechanically sound and will remain so for at least 60 days or 3,000 miles of operation, whichever occurs first, and (3) a used motor vehicle may be sold "as is" by a dealer only if the vehicle is 10 years of age or older.

Attorney General's proposal that (1) provides that certain materials provided to the Attorney General following a breach of security involving electronic personal information shall be provided to the Attorney General in a form and manner prescribed by the Attorney General, (2) creates a new definition for a "massive breach of security" as a breach of security where (A) the personal information of at least one hundred thousand residents of this state has been breached or is reasonably believed to have been breached, and (B) the breach of security occurred due to the unauthorized use of a computer or computer network, (3) requires a third-party forensic examination, analysis and report following a massive breach of security, and (4) imposes an additional penalty for any party who fails to submit a third-party forensic report to the Attorney General following a massive breach of security, including a $100,000 fine for small businesses and a $500,000 for all other businesses. Failure to comply with the requirements of this bill shall constitute an unfair trade practice for purposes of section 42-110b and shall be enforced by the Attorney General.
